Delhi High Court Grants Transit Bail To Man Booked For Inciting Communal Hatred Against Nagaland Residents

Kohima, Oct 24: The Delhi High Court has granted two weeks of transit bail to Akash Tanwar, accused of making a social media post that allegedly incited communal hatred and disharmony against the people of Nagaland.

Tanwar, a Delhi resident, was arrested by Nagaland Police in November last year following an FIR lodged under the Indian Penal Code and the SC/ST Act. The court observed that Tanwar’s remarks, while offensive, did not specifically target individuals based on their caste or tribal identity.

Justice Amit Mahajan stated that Tanwar’s actions may have maligned the people of Nagaland, but not solely because of their caste. The court allowed Tanwar to seek legal remedies in Nagaland, dismissing his plea to quash the FIR.

Tanwar’s counsel argued that registering the FIR in Nagaland was an abuse of process since he had no connection to the state. In contrast, Nagaland’s counsel asserted that Tanwar’s video targeted the Naga people, causing communal enmity.

The court emphasized that both Delhi and Nagaland courts have jurisdiction over the matter, allowing Tanwar to file a similar petition in Nagaland.
