A Special POCSO Court in Manipur has sentenced a 48-year-old man to spend the remainder of his natural life behind bars for the aggravated sexual assault of his seven-year-old daughter. The landmark judgment, delivered by Special Judge Lamkholal Kipgen on May 12, concludes a harrowing legal chapter that began when the crime first came to light four years ago.
The convict, identified as K. Besii of Kalinamai village, was found guilty under Section 6 of the Protection of Children from Sexual Offences (POCSO) Act. The court’s decision follows an investigation triggered by a complaint from Child Line Senapati in March 2022.
While the trial formally commenced in early 2026, the court moved decisively this month, pronouncing the conviction on May 7 before sealing the perpetrator’s fate with a life sentence five days later.
In a scathing observation, Judge Kipgen described the assault as “heinous and barbaric,” noting that the survivor was of a tender age when her own father inflicted irreversible physical and psychological trauma upon her. The prosecution successfully argued that Besii had profoundly abused his position of trust, an act the court noted “tears through the foundational fabric of familial trust.” While the bench acknowledged the gravity of the incestuous violence, it opted for a life term over capital punishment, stating the case did not strictly meet the “rarest of rare” criteria for the death penalty.
The judicial intervention extended beyond the prison sentence, as the court ordered the state government to provide Rs 7 lakh in compensation to the survivor. To safeguard the child’s future, the court directed that 80 percent of this sum be secured in a fixed deposit until she reaches adulthood. The remaining portion is to be utilized for her immediate educational and medical expenses, subject to the approval of the District Legal Services Authority.
Currently residing in a shelter home, the survivor will continue to receive free legal aid and comprehensive support services as mandated by the court. Along with his life term, Besii was slapped with a fine of Rs 20,000, the default of which will add six months to his incarceration.
This ruling stands as a significant moment for the Senapati judiciary, emphasizing that the law will act as a shield for the most vulnerable, even when the threat originates from within the home.
